In December 2017, Kohn Law Office, in association with Skolnick Law Group, obtained a $1,000,000 settlement just weeks before trial for the brother of a 63-year-old disabled man who lost his life in a pedestrian accident.

The decedent had recently left the new Palomar Hospital in Escondido and was seated in a wheelchair outside the emergency room entrance. The defendant, an 89-year old man, lost control of his truck, drove onto the sidewalk, and fatally struck the decedent. Although it was clear that the defendant was not capable of safely operating the vehicle due to his age, and that the decedent had done nothing to cause the accident, a settlement was still initially resisted by the responding insurance companies. The settlement payment was split as follows:

• $500,000 paid by underlying carrier USAA Insurance Co.
• $500,000 paid by the umbrella carrier, Scottsdale Insurance Co.
